User Agreement

Welcome to ”Bonzun IVF”. Before you start to use the service we strongly recommend that you read through these “General Terms and conditions Bonzun IVF”.

We reserve the right, at our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms and Conditions and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of our service after the date such revised Terms are posted.

Please NOTE that Bonzun IVF does not take any legal or medical responsibility for how you interpret or use information in Bonzun IVF. Your situation is unique and for medical advice you should turn to your doctor and/or clinic.

About Bonzun IVF

Bonzun IVF is an application filled with information and functionality that will support users before, during and after an IVF treatment. All content is strictly evidence-based and validated in collaboration with IVF doctors, scientists, psychologists and fertility experts.

This service is provided by “Bonzun Health Information AB”, 556326-8514.

Access to Bonzun IVF

Only authorized users who have purchased a subscription (unlimited use OR monthly subscription) or have received a valid Clinic Code from a partnering IVF clinic may use Bonzun IVF.
By accessing Bonzun IVF you agree that you have read, understood, and agree to be bound by all of these “Terms and conditions Bonzun IVF” and “Privacy policy, Bonzun IVF”.
Access to the Bonzun IVF is granted by entering a code provided by your IVF clinic or by purchasing a subscription or a one-time unlock fee through the Apple App Store or the Google Play Store.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device, and you agree to accept responsibility for all activities that occur under your account or password.

Definitions

“Bonzun IVF”, the “service” or the “application” refers to Bonzun IVF digital service provided as a mobile application.

The ”clinic” refers to clinics that are licensed by Bonzun IVF

The “user” or “you” refers to the user of Bonzun IVF service.

Privacy policy

We care about data privacy and security. In order to use Bonzun IVF we require you to submit certain personal data. Please read how we handle personal data in ”Privacy Policy, Bonzun IVF”. By using the service, you agree to be bound by our Privacy Policy.

Changes and Limitation of liability

Bonzun IVF reserves the right to, change the visual expression and to carry out updates at any time without notice. Bonzun IVF also reserve the right to change, close down functionality in Bonzun IVF including, but not limited to, functionality, functions, services, at any time without notice. All changes and updates in functionality, functions and services are included in ”Terms and conditions Bonzun IVF”.

Bonzun IVF reserve the right to change, modify, or remove the contents of the application at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information in our application. We also reserve the right to modify or discontinue all or part of the application without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the service.

You are aware that access to the internet is required to access and use certain parts of Bonzun IVF and that such access is neither installed, maintained or established by Bonzun IVF, nor that Bonzun IVF cannot guarantee any secure connection to Bonzun IVF.

We cannot guarantee that the application will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the application, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the application at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the application during any downtime or discontinuance of the application. Nothing in these Terms and conditions will be construed to obligate us to maintain and support the application or to supply any corrections, updates, or releases in connection therewith.

Bonzun IVF reserves the right, at any time, with or without prior notice, to take action that affects the user’s access to the service, if Bonzun IVF considers this necessary. Exercising the above rights does not entitle you as a user to claim any compensation.

In no event will we, our employees or partners be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special or punitive damages.

Misuse

If you in any way misuse Bonzun IVF or violate these terms and conditions, we reserve the right to close your account and block all use of Bonzun IVF.

Immaterial rights

Bonzun IVF own all rights to, including but without limitation, intellectual property rights pertaining to Bonzun IVF, origin, patents, trademarks, company, designs, functionality, software, source code, databases, business plans, design and know-how (collectively the “content”), regardless of whether the rights are registered or not. All documentation, including manuals, user guides, or other written, electronic or non-electronic, descriptions of how Bonzun IVF is created and used is considered part of Bonzun IVF and is therefore subject to the same restrictions. No information in the General Terms and Conditions shall be construed so that any of these rights are wholly or partly transferred to you.

The user is aware of and confirms that: (i) the material is the property of Bonzun IVF or its affiliate(s) and is copyrighted, and (ii) customer does not acquire any right to any material except a limited right to temporary use the Material necessary for the Customer’s provision of the Service.

Prohibited activities

You may not access or use the application for any purpose other than that for which we make the Bonzun IVF available. The service may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Bonzun IVF.

As a user of the service, you agree not to:

systematically retrieve data or other content from the application to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
make any unauthorized use of the application, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
use a buying agent or purchasing agent to make purchases in the application.
use the application to advertise or offer to sell goods and services.
circumvent, disable, or otherwise interfere with security-related features of the application, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the application and/or the Content contained therein.
engage in unauthorized framing of or linking to the application.
trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords;
make improper use of our support services or submit false reports of abuse or misconduct.
engage in any automated use of the application, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
interfere with, disrupt, or create an undue burden on the application or the networks or services connected to the application.
attempt to impersonate another user or person or use the username of another user.
sell or otherwise transfer your profile.
use any information obtained from the application in order to harass, abuse, or harm another person.
use the application as part of any effort to compete with us or otherwise use the application and/or the Content for any revenue-generating endeavor or commercial enterprise.
decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the application.
attempt to bypass any measures of the application designed to prevent or restrict access to the application, or any portion of the application.
harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the application to you.
delete the copyright or other proprietary rights notice from any Content.
copy or adapt the application’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the application or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the application.
upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the application, or using or launching any unauthorized script or other software.
disparage, tarnish, or otherwise harm, in our opinion, us and/or the application.
use the application in a manner inconsistent with any applicable laws or regulations.

Support, communication and contact information

You agree that all communication between Bonzun IVF and you related to Bonzun IVF may be done electronically, for example, by e-mail, text/sms, via the Service or via any other digital communication channel. Examples of messages are information about malfunctions, new versions, other information about Bonzun IVF and other support.

Disclaimer

The service is provided on an as-is and as-available basis. No specific warranties are given, whether express or implied, including but without limitation to function, accessibility and content.

Under no circumstances shall Bonzun IVF be liable for any consequential loss or other indirect damage of whatever kind it may be.

Third Party

Bonzun IVF has the right to assign its rights and obligations under the General Terms and conditions to third parties.

The application may contain (or you may be sent via the application) links to other websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (“Third-Party Content”). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the application or any Third-Party Content posted on, available through, or installed from the application. If you decide to leave the Site and access the Third-Party Websites or to use or install any Third-Party Content, you do so at your own risk.

Force majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under the General Terms and conditions Bonzun IVF that is caused by events outside our reasonable control, such as thunderstorms, fire, power outages, strikes, wars, mobilization or military summons of greater scope, requisition, seizure, government regulations, government action, newly arrived or amended legislation, conflict in the labor market and thereby equal circumstances.

Dispute Resolution

For General Terms, Swedish law shall apply unless mandatory law prescribes otherwise. Disputes arising in connection with the General Terms and Conditions or otherwise in connection with your use of Bonzun IVF shall be settled in a public court, whereby the Stockholm District Court shall be the first instance.

Social media

As part of the functionality of the Service, you may link your account with online accounts you have with third-party service providers (each such account, a “Third-Party Account”) by either: (1) providing your Third-Party Account login information through the Service; or (2) allowing us to access your Third-Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent and warrant that you are entitled to disclose your Third-Party Account login information to us and/or grant us access to your Third-Party Account, without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account, and without obligating us to pay any fees or making us subject to any usage limitations imposed by the third-party service provider of the Third-Party Account. By granting us access to any Third-Party Accounts, you understand that we may submit to and receive from your Third-Party Account additional information to the extent you are notified when you link your account with the Third-Party Account. Depending on the Third-Party Accounts you choose and subject to the privacy settings that you have set in such Third-Party Accounts, personally identifiable information that you post to your Third-Party Accounts may be available on and through your account on the Site. Please note that if a Third-Party Account or associated service becomes unavailable or our access to such Third-Party Account is terminated by the third-party service provider, then Social Network Content may no longer be available on and through the Service. You will have the ability to disable the connection between your account on the Service and your Third-Party Accounts at any time. Please note that your relationship with the third-party service providers associated with your third-party accounts is governed solely by your agreement(s) with such third-party service providers. We make no effort to review any Social Network Content for any purpose, including but not limited to, for accuracy, legality, or non-infringement, and we are not responsible for any Social Network Content. You can deactivate the connection between the Service and your Third-Party Account by contacting us or through your account settings (if applicable). We will attempt to delete any information stored on our servers that was obtained through such Third-Party Account, except the username and profile picture that become associated with your account.

TERM AND TERMINATION

These Terms of Use shall remain in full force and effect while you use Bonzun IVF. Without limiting any other provision of these terms of use, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the service (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these terms of use or of any applicable law or regulation. we may terminate your use or participation in the service or delete [your account and] any content or information that you posted at any time, without warning, in our sole discretion.
